How do you remove a name from a mortgage loan?

My cousin has just gotten divorced and his ex-wives' name is still on the mortgage how does he get her name off the deed?

Contact the mortgage holder. They have a form for this that both parties have to sign. This will not change the terms of the original mortgage - if he wants to do that, he will have to re-finance. Either way, they will want financial information from your cousin to make sure he is able to support the mortgage on his own - otherwise, they will refuse to remove the wife in order to keep her ';on the hook'; in case he defaults.How do you remove a name from a mortgage loan?
Generally, you have to refi. The divorce controls things between the couple, but not between the couple and third parties. Right now is a pretty good time to refi.





BTW, he also needs to get her OFF the deed. Can be done in conjunction with refi.
Talk to the attorney that originally wrote the deed for the house. For a small fee he can change the documents to reflect the current situation. It will be about $100 or so to change plus filing fees with the County.
The person who wants to keep the house has to refinance the house into their own name.
