Am i entitled to help with my mortgage payments while receiving income support?

I split with my partner three months ago, since then he has give me nothing and says i should go through the CSA. I am now receiving income support and child tax credits, but i am finding it difficult to pay my mortgage. I know i should be able to get help with this but wondered would i recieve the help if his name was also on the mortgage, there is no way he would take his name of the mortgage.Am i entitled to help with my mortgage payments while receiving income support?
Mortgage interest


If you have a mortgage or loan taken out to buy your home, Income Support will help you with the interest payments. The Income Support scheme will not help with repayments of capital or with the premiums or any endowment or pension policy that is associated with the loan. [Legislation (77)]





Income Support can only help with the interest on:





loans for 鈥榓cquiring an interest in a home鈥?


or loans for financing repairs or improvements that are necessary to maintain the fitness of your home for human habitation


or loans taken out to repay loans that were used for either of the above


There is a limit of 拢100,000 on the amount of capital that Income Support can help with the interest on. This means that if the outstanding capital on your loan, or loans, is more than 拢100,000 then only the interest on 拢100,000 can be met through Income Support help with the mortgage interest payments.





When will I get the first payment?


People over 60 are entitled to help immediately, but there are waiting periods for everyone else. If you took out your mortgage after 2 October 1995, payments normally won't start until 39 weeks after you claim. How ever, you may get payments sooner if:





you got your mortgage before 2 October 1995


you are a carer and the person you look after is eligible for certain benefits


you are a single parent whose partner has died or left


you are an offender and are waiting for a trial or sentence


your have mortgage protection insurance but it won't pay because of a medical condition you already had when you took out the insurance


your mortgage replaces a previous mortgage on the same property, which was taken out with the same lender on or before 2 October 1995


If you are in one of these situations, you will probably be eligible for no interest at all for the first 8 weeks, half of the interest for the next 18 weeks, and all of the interest after 26 weeks. You will have to pay for any interest that is not covered from any income or savings you may have


How is it paid?


Income support mortgage interest is usually paid directly to your lender at the end of every four weeks. This is the case even if your mortgage payments are due on a monthly basis, so you may appear to be behind with payments. The rules about how much you get are complicated.





If you are separated and it is possible for you to receive some help with mortgage payment from your ex-partner, you will need to talk to an adviser to check how these payments are to be made. They may affect the amount of benefit you are entitled to.





If your home is considered to be too expensive or too large for your needs, any payments you receive may be reduced to cover the costs you would have if you could reasonably be expected to move to a more affordable home. If you are in this situation, get advice. It may be possible to show that it is not reasonable to expect you to move somewhere else.





The amount you get is also based on the average interest rate at the time you make your claim. If your mortgage interest rate is lower than average all of the interest will be covered, but if it is higher than average you will have to pay the difference from any income or savings you may have. It might be possible to negotiate with your lender if the difference is very small and you will be able to pay it off soonAm i entitled to help with my mortgage payments while receiving income support?
If your partner's name is on the mortgage and he is still working then you won't get benefits to pay the mortgage. If it's just in your name and you aren't working the DSS will usually contribute by paying interest on the mortgage, but only after quite a long period. Someone mentioned 9 months, my guess was 6 months but 9 is probably more correct.





In any event, please please please contact your lender. Find someone that you can speak to, and use them as a contact point to go back to for information/advice on your mortgage throughout this horrible situation. Lenders will usually try to help in whatever way they can, perhaps by allowing you to pay interest only, or a reduced payment in another way. Pay whatever you can onto the mortgage: a part payment is better than no payment and many places will allow you to pay extra over the counter as and when you can afford to do it. However, if it's with a bit of a dodgy company rather than a high street place check they won't slap on extra charges for taking additional repayments. If the mortgage is in joint names, keep a record (receipt preferrably) of any money that you have paid onto the mortgage as this might be useful/necessary to prove that you have done your best to pay your debt. If he has paid nothing then you are then in the strongest position.





Talk to the DSS and any other agencies that you can (Surestart, Citizens Advice etc) as sometimes there are benefits to be claimed that you won't be automatically told about.

What cooldad says is right,but, a big BUT if your partners name is also on the mortgage ,not a chance in hell as they may see it as a con,otherwise get your partner to pay .Now please dont shoot the messenger ,only telling you the way it is
what you shud do is start divorce procedings u will get legal aid..a judge will not see you homeless ..ure x will no doubt have to pay the morgage..my partner had a court order to pay his xs morgage and there wasnt any kids involved,,his name is on the morgage but the judge ordered him off the deeds ..she is selling now ..so he will no longer have to pay the morgage as her new property will be in he name only..!! hope this helps

i believe they will pay the interst part of your mortgage after a period of 9 months but not any capital repayments


contact citizens advice they know all abut thses things and are free
Thats what insurance is for isn't it?
